Immediate relatives

Immediate relatives of American citizens are:
Father, Mother, Spouse, Unmarried children under the age of 21.
Orphans adopted abroad or in the United States.

Family preference

First preference (F1) - unmarried children of US citizens of any age.

Second preference (F2) - spouses (same or opposite sex), minor children, unmarried children (aged 21 or over) of permanent residents.

Third preference (F3) - married children, their spouses and their minor children.

Fourth preference (F4) - siblings, their spouses and minor children. Half-brothers and half-sisters, as well as adopted siblings are also eligible in this category.

How does the green card process work?

1. Petição inicial (Formulário I-130):
O patrocinador deve preencher e enviar o Formulário I-130 ao USCIS (Serviço de Cidadania e Imigração dos EUA) para demonstrar o vínculo familiar.

2. Aprovação da petição:
Se o USCIS aprovar a petição, o caso será enviado ao National Visa Center (NVC), que coordena os próximos passos.

3. Disponibilidade de visto:
Para categorias com limite anual, o beneficiário deve aguardar que um visto esteja disponível de acordo com o “Visa Bulletin”.

4. Consular process or adjustment of status:

Fora dos EUA: O beneficiário comparece a uma entrevista em um consulado ou embaixada americana.
Dentro dos EUA: O beneficiário pode solicitar o ajuste de status (Formulário I-485).

5. Entrevista e aprovação:
O solicitante será entrevistado para confirmar a elegibilidade e a autenticidade do vínculo familiar.
